Industrial mining/ Industrial Mining Permit

Application procedure

      • Application: Submitted at the Mining Cadastre Service in three copies with acknowledgment of receipt;
      • Can occur at any time during the term of the prospecting permit.

Documents making up the application file:

      • an application sent to the Ministry of Mines,
      • the substances corresponding to the deposits for which the permit is requested;
      • the definition of the summits of the area requested as well as the area ;
      • the location of the perimeter of the requested permit on a 1/200 000 topographical map ;
      • a detailed map at an appropriate scale where the perimeter summits are linked to well defined points.
      • a memory indicating the results of works carried out and expenses incurred during the last term;
      • a feasibility study, the environmental impact study and a rehabilitation program of sites to be exploited;
      • the commitment of the applicant, in case of attribution of the operation permit, to attribute 10% of the shares or initial shares of the operation company;
      • the payment receipt of the fixed duty.

Attribution: by decree taken in the Council of Minister after public survey

Term:

      • Industrial operation permit valid for 20 years, renewable every 5 years until reserves completion.
      • Small scale operation permit for 10 years, renewable every 5 years until the completion of reserves.

Application processing deadline: a maximum of 4 months between the submission of the application and its presentation at the Council of Ministers.

Renewal procedure

Application: submitted in the Service of Mining Cadastre in 10 copies, with acknowledgment of receipt at least three months before the current term

Documents making up the application file:

      • an application sent to the Minister of Mines;
      • the exact geographical location of the deposits for which the renewal is requested;
      • a report ascertaining the continuation of activity during the expiring period;
      • a report on works carried out on the permit accompanied with all plans and operation documents;
      • an actualization of the deposit development and operation plan;
      • a report of exploration activities undertaken and the update on reserves depletion ;
      • the payment receipt of fixed duty.

Renewal attribution: decree taken in the Council of Ministers

Application processing deadline: a maximum of 4 months between the submission of the application and its presentation in the Council of Ministers.

Other possibilities for the permit holders:

Extension of the geographical perimeter: can be requested on the condition that the perimeter requested be contiguous to the initial permit and which area is not higher than the half of the one pursuant to which the application is presented.

Transfer

        :

        • can be contemplated only for a legal person constituted in accordance with the laws of Burkina Faso and have its registered office;
        • upon application sent to the Minister of Mines processed and making sure that the assignee complies with all the requirements relating to the works and that the transferee offers, to the assignee at least the same guarantees of obligation implementation

Partial or total waiving: authorized at any time but must however be approved by the Mining Administration.
